“Protection of the Environment in Relation to Armed Conflict – Beyond the ILC”. A Workshop Report from an International Environmental Law Perspective.
On 7 and 8March 2019, fourteen speakers assembled in the historic library of the Aby Warburg Haus in Hamburg following the invitation of the law faculties of the University of Hamburg and Lund University. The Speakers addressed the topic ‘Protection of the Environment in Relation toArmedConflict – Beyond the ILC’ (PErACWorkshop) which is currently being analysed by the International Law Commission (ILC).
The ILC has explored the field of ‘Protection of the Environment inRelation toArmed Conflict’ by scrutinizing, inter alia, international environmental law (IEL) and international human rights law (IHRL) in relation to international humanitarian law (IHL). In doing so, the ILC divided the Draft Principles into the pre-conflict phase, the during armed conflict phase and the post-conflict phase – using a temporal approach as amethod for itswork. This allows for a broad perspective includingmore overlaps with IEL and IHRL.

Am 21.11.2023 wurde die Delegierte Verordnung (EU) 2023/2486 der Europäischen Kommission zur Ergänzung der europäischen Taxonomie- Verordnung im Amtsblatt der Europäischen Union veröffentlicht (im Folgenden: Delegierte Verordnung).
Kreislaufwirtschaft in der Steiermark – zukunftsweisende Ansätze auf Landesebene

Das Land Steiermark hat sich mit dem Landes-Abfallwirtschaftsplan Steiermark 2019 (Winter 2019) dem Weg zur ressourceneffizienten Kreislaufwirtschaft verschrieben. Er definiert als übergeordnete Vision den Wandel zur Kreislaufwirtschaft bis zum Jahr 2050 und legt in diesem Sinne konkrete Strategien und Ziele für die nächsten Jahre fest. Dieser Weg erfordert eine Entkopplung des Wirtschaftswachstums vom Ressourcenverbrauch. Anstelle der bisher in vielen Bereichen noch immer vorherrschenden linearen Produktions- und Nutzungsketten Primärrohstoffentnahme, Produktion, Nut-zung, Entsorgung) muss eine möglichst lange und werterhaltende Nutzung von Produkten und Rohstoffen im Mittelpunkt stehen. Die gesetzlichen Grundlagen dafür wurden bereits mit der Einführung der fünfstufigen Abfallhierarchie in der europäischen Abfallrahmenrichtlinie 2008 geschaffen.

Der Europäische Gerichtshof hat mit Urteil vom 25.7.2018 (Rs. C‑528/16) entschieden, dass Organismen, deren Erbgut mit Verfahren der sog. ortsspezifischen Mutagenese verändert wurde, dem europäischen Gentechnikrecht unterfallen. Treaty congestion in international environmental lawhas led to some confusion regarding the coordination of multilateral environmental agreements aswell aswith regard to the harmonization of norms across treaties. In this paper, the Wadden Sea serves as an example to illustrate the multilayered protection a “protected area” in international environmental law can enjoy based on the parallel application of several environmental treaties to one single protected area.
